Effective from the date of booking

Effective Date: 1 July 2026

These Terms of Service govern all photography, videography, editing, and associated media services supplied by ALX Creative Media ("ALX Creative Media", "we", "our", or "us") to the client ("Client", "you", or "your"). By engaging or booking our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Fees & Payment

1.1 Pricing

Unless otherwise stated in writing, all prices are quoted in Australian Dollars (AUD) and include GST.

1.2 Payment Terms

Invoices must be paid within fourteen (14) days of the invoice date unless an alternative payment arrangement has been agreed to in writing.

1.3 Overdue Accounts

Any invoice remaining unpaid after sixty (60) days may incur interest calculated daily at the Reserve Bank of Australia's cash rate plus 2% per annum. Alternatively, ALX Creative Media may engage a debt recovery agency, with all associated recovery costs payable by the Client.

1.4 Deposits

Projects valued above $5,000 plus GST require a 50% deposit before work commences.

Deposits are non-refundable except where ALX Creative Media cancels the project or is otherwise in breach of this agreement.

The remaining balance becomes payable upon delivery of the final project or written approval of the completed work.

1.5 Ownership Prior to Payment

All copyright, ownership and usage rights remain the exclusive property of ALX Creative Media until full payment has cleared. No rights to use, reproduce or distribute the deliverables are granted until payment has been received in full.

2. Bookings & Scheduling

2.1 Booking Confirmation

A booking is only confirmed once ALX Creative Media issues a written appointment confirmation by email.

Requested dates remain provisional until confirmed. Verbal discussions or informal agreements do not constitute a confirmed booking.

2.2 Right to Refuse Work

ALX Creative Media reserves the right to decline any booking at its sole discretion.

Reasons may include, but are not limited to:

• safety concerns

• restricted or unsuitable site access

• incomplete project information

• scheduling conflicts

• conflicts of interest

Where a booking is declined by ALX Creative Media, any monies paid will either be refunded in full or credited toward a future booking.

2.3 Property Access

The Client is responsible for ensuring safe and unrestricted access to the property or filming location at the scheduled time.

If access cannot be obtained due to locked premises, unavailable keys, uncooperative occupants or similar issues, the booking may be cancelled and charged in full.

The Client is responsible for coordinating access with owners, tenants, agents or any other relevant parties.

3. Pricing, Packages & Additional Charges

3.1 Service Packages

Fees are based on the agreed package, inclusions and project scope confirmed at the time of booking. Once confirmed, pricing is fixed unless the scope changes.

3.2 Additional Fees

Where applicable, ALX Creative Media may charge additional fees including:

• Same-day delivery from $100

• Supply of raw files (where agreed) from $600

• Project archive storage beyond 12 months at $100 per project per year

These fees may be reduced or waived at ALX Creative Media's discretion.

3.3 Travel Charges

Travel fees apply to projects outside the ACT region, including Yass, Gunning, Goulburn, Braidwood, Michelago, Cooma and the Snowy Mountains region.

Travel is charged per hour from Canberra CBD during off-peak periods in the ACT region.

Flat travel rates include:

• Cooma – $150

• Berridale – $200

• Jindabyne – $250

Flat rate travel will be split between all jobs booked for the day.

4. Cancellations, Rescheduling & Weather

4.1 Cancellation Fees

• Cancellations within 48 hours of the scheduled booking incur a fee equal to 25% of the booking value.

• Cancellations within 24 hours incur a 50% cancellation fee.

4.2 Rescheduling

Rescheduling within twenty-four (24) hours of the booking may attract a rescheduling fee depending on crew allocation and travel arrangements.

A booking may only be rescheduled once and must be completed within fourteen (14) days of the original booking date. Otherwise, cancellation fees will apply.

4.3 Editing Already Commenced

Where post-production has already begun, all work completed up to the cancellation date or time remains payable.

4.4 Weather

If weather conditions are unsuitable, ALX Creative Media may postpone the shoot, schedule permitting, on client request.

Where weather prevents safe or practical delivery of services, cancellation fees will not apply.

4.5 Reserved Time

Time allocated for filming, photography or editing is reserved exclusively for the Client and is therefore non-refundable.

5. Creative Direction & Project Brief

5.1 Creative Style

The Client acknowledges that they have reviewed ALX Creative Media's previous work and accept our creative style and artistic approach.

Provided the final work reasonably reflects the agreed project brief, dissatisfaction with creative style alone will not entitle the Client to a refund or complimentary reshoot.

5.2 Project Brief

The Client must supply a written project brief before editing begins.

The brief should include:

• project objectives

• key messaging

• intended audience

• preferred tone

• reference materials

• any specific requirements

If no written brief is supplied, ALX Creative Media will complete the project based on the agreed scope and accepted industry standards.

Project outcomes will be assessed against the agreed brief rather than subjective personal preference.

5.3 Changes to Scope

Changes to project objectives, messaging, structure or deliverables after editing has commenced will be treated as additional work and quoted separately.

Where additional shooting time is required, reshoot fees outlined in Clause 6.2 will apply.

6. Revisions

6.1 Included Revisions

Projects include:

• One (1) revision round for photography

• Two (2) revision rounds for videography

Revision requests must be consolidated into a single email or document for each round.

ALX Creative Media reserves the right to combine multiple revision requests into one revision cycle.

6.2 Reshoots

Reshoots are not included within revision allowances.

Additional visits requested by the Client, or required due to changes in scope, will be charged from $150 per 15-minute booking block.

All reshoot fees will be confirmed before work proceeds.

6.3 Additional Revisions

Revision requests exceeding those included in the agreed package, or requiring significant additional work, will incur additional charges.

Any such costs will be quoted and approved before commencement.

7. Intellectual Property & Licensing

7.1 Copyright Ownership

All original photography, videography, raw footage, editing files, colour grades, project files and derivative works remain the exclusive intellectual property of ALX Creative Media.

Ownership is retained regardless of payment or project completion.

7.2 Client Licence

Following receipt of full cleared payment, ALX Creative Media grants the Client a worldwide, perpetual, royalty-free, non-exclusive, non-transferable and non-sublicensable licence to use the final delivered content for lawful marketing, promotional and business purposes relating to the relevant property or brand.

7.3 Prohibited Uses

Unless written approval is obtained, the Client must not:

• alter or edit delivered work

• create derivative works

• remove branding, credits or watermarks

• use content in political, religious or offensive contexts

• transfer or sublicense the material

• incorporate the material into competing commercial services

7.4 Attribution

Unless otherwise agreed in writing, the Client agrees to credit ALX Creative Media in public-facing uses where practical, for example:

"Photography by ALX Creative Media."

7.5 Portfolio Rights

ALX Creative Media retains the unrestricted right to use completed work for:

• portfolio display

• marketing

• case studies

• social media

• competitions and award submissions

Clients wishing to exclude their project must notify ALX Creative Media in writing within seven (7) days of delivery.

Requests received after this period cannot be guaranteed.

7.6 Raw Files

Raw footage, RAW image files, project files, drafts and other production assets remain the exclusive property of ALX Creative Media.

Raw files will not be supplied except under a separate written agreement and subject to a minimum fee of $600.

7.7 Licence Duration

The licence granted to the Client continues indefinitely provided all payment obligations and these Terms are complied with.

Any breach of these Terms may result in immediate termination of the licence.

8. Subcontractors

ALX Creative Media may engage subcontractors, assistants or specialist creatives where required.

All subcontractors are subject to confidentiality obligations.

ALX Creative Media remains fully responsible for the quality and delivery of all services.

9. Liability

9.1 Limitation of Liability

To the maximum extent permitted by law, ALX Creative Media's liability is limited to the total fees paid for the relevant services.

We are not responsible for indirect, consequential or economic losses including loss of profit, business opportunity, rental income, marketing performance or campaign outcomes.

9.2 Defect Claims

Any concerns regarding defects or errors must be reported within fourteen (14) days of delivery.

Claims made after this period will be considered waived.

9.3 Indemnity

The Client agrees to indemnify ALX Creative Media against claims arising from:

• misuse of delivered materials

• third-party copyright or intellectual property claims arising from the Client's use

• unlawful or offensive use of the deliverables

10. Force Majeure

ALX Creative Media will not be liable for delays or inability to perform services resulting from circumstances beyond our reasonable control, including:

• natural disasters

• severe weather

• pandemics

• government restrictions

• illness

• equipment failure

• internet outages

• third-party supplier failures

Where possible, projects will be postponed.

If postponement exceeds sixty (60) days, the Client may cancel and receive a refund of any deposit paid.

11. General Terms

11.1 Entire Agreement

These Terms, together with any signed proposal, quotation or project agreement, represent the complete agreement between the parties and replace all prior discussions or representations unless expressly recorded in writing.

11.2 Dispute Resolution

The parties agree to first attempt to resolve disputes through good-faith negotiation.

If a resolution cannot be reached within thirty (30) days, either party may commence mediation or legal proceedings within the Australian Capital Territory.

11.3 Assignment

The Client may not assign their rights or obligations under these Terms without written consent from ALX Creative Media.

ALX Creative Media may assign these Terms in connection with a merger, acquisition or sale of its business.

11.4 Notices

Formal notices must be provided in writing to:

Notices are deemed received upon successful email delivery or three (3) business days after posting.

11.5 Governing Law

These Terms are governed by the laws of the Australian Capital Territory, Australia.

11.6 Amendments

No amendment to these Terms is effective unless made in writing and agreed by both parties.

If any provision is found to be unenforceable, the remaining provisions will continue in full force and effect.
